CENTRAL PLANNING BOARD PUBLIC HEARING

ON PROPOSED REDEVELOPMENT AREA

TAKE NOTICE on January 11, 2016 at 6:30 p.m. at the Municipal Council Chamber at City Hall, 920 Broad Street, Newark, New Jersey, the Central Planning Board of the City of Newark shall hold a public hearing for the purpose of hearing persons who are interested in or would be affected by a recommendation to the governing body that the area described below and set forth in the Planning Board’s preliminary investigation and report, or any part thereof, be determined, or not be determined, to be an “area in need of redevelopment” according to the criteria set forth in section 5 of P.L. 1992 c.79 (N.J.S.A. 40A:12A-5) and to hear objections to and evidence in support of a determination that the area described below is and shall be determined to be an “area in need of redevelopment.” Determination of whether or not the below described area, or any part thereof, will be recommended to the governing body to be an “area in need of redevelopment” shall be made by Resolution at the conclusion of the public hearings.

The hearing scheduled for January 11, 2016 is the first step in a multi-step process in determining whether the area should be designated as an area in need of redevelopment. After consideration by the Planning Board, a recommendation will be made to the governing body on this issue. In the event that at the conclusion of the process some or all of the area is determined by the governing body to be an area in need of redevelopment, such a determination may have an impact on the ownership of property so designated. In particular, a determination that property is designated as an area in need of redevelopment would operate as a finding of public purpose and would allow the City of Newark to acquire the property in the area by condemnation (against the owner’s will) for redevelopment purposes.

The Central Planning Board was directed by the Municipal Council, pursuant to Resolution 7R3-B(s) (adopted January 13, 2015, to conduct a preliminary investigation in order to investigate the area listed within the chart below and generally described as the West Ward Area 1 Study Area (the “Study Area”) to determine if the Study Area should be determined to be an area in need of redevelopment under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq. (the “LRHL”). The following properties are included within the Study Area presently being investigated:

  1. Location and Map

A map showing the boundaries of the Study Area and the location of the properties included therein and a statement setting forth the basis of the preliminary investigation of the Study Area being presently investigated are available for inspection and copying at the office of the City Clerk in Room 415 and the office of the Central Planning Board in Room 112 at City Hall, 920 Broad Street, Newark, New Jersey on Monday through Friday from 8:30 a.m. to 4:30 p.m. In addition, a copy of the Investigation report by H2M Associates, the Planning Board’s consultant, is available for inspection and copying at the office of the Central Planning Board in Room 112 at City Hall.

All persons who are interested in or would be affected by the preliminary investigation to determine whether the proposed area, or any part thereof, is a redevelopment area and should be determined to be a redevelopment area according to the criteria set forth in Section 5 of P.L. 1992, c.79 (N.J.S.A. 40A:12A-5) are invited to attend the meeting and ask questions and provide their objections to or evidence in favor of such determination either orally or in writing.

Any person seeking to challenge the redevelopment designation and the condemnation authority arising therefrom must file litigation within 45 day of the Municipal Council’s adoption of the resolution making this redevelopment designation. After that time, a redevelopment plan for the Study Area may be adopted by the Municipal Council, redevelopment activities may be commenced within the Study Area by the City (or its designated redevelopment entity) and/or its designated redeveloper(s), and the City (or its designated redevelopment entity) may proceed to condemn properties within the Study Area in accordance with applicable law.

Economic and Housing Development Offices:

  • Housing Assistance administers the new construction and rehabilitation/renovation of safe, affordable housing and public facilities and nonprofit owned, non-residential facilities.
  • Property Management provides real estate management services for properties acquired by the City of Newark until they can be returned to the city tax rolls.

    • Division of Boards & Commissions provides administrative and staff support to the Newark Central Planning Board, the Zoning Board of Adjustment, the Landmarks and Historic Preservation Commission and the Environmental Commission. Applications for site plan review, environmental review, zoning variances and exterior renovations of properties located in historic districts can be obtained from this office.
